Can I get a U Visa if I never filed a police report?

Possibly. A U Visa requires certification from a law enforcement or other qualifying agency that you were helpful in an investigation, but a formal police report is not the only route to that certification.

Can I apply for VAWA if I am no longer married to the abuser?

Often yes. A VAWA self-petition can be filed within two years of a divorce if the divorce was connected to the abuse. The timing matters, so ask early.

Can I refuse a breath test in Georgia?

You can refuse, but under Georgia’s implied consent law a refusal can suspend your license for a year and may be used against you at trial. It depends on the situation, and a lawyer should be your next call either way.

Does a DUI affect my green card application?

A single DUI is usually not deportable, but it can affect discretionary decisions, and a DUI with drugs, a child in the car, or a suspended license is far more serious. Get both attorneys on it before the plea.

What happens at a first appearance hearing?

Within 72 hours of arrest a magistrate reads the charges, sets or denies bond, and appoints counsel if you cannot afford it. You are not asked to enter a plea.
