Common questions

Should I talk to the detective before I have a lawyer?

No. You can be polite and still decline. Say you want a lawyer present and then stop talking. Nothing you explain to a detective without counsel helps you later, and Brandon has read hundreds of those statements from the other side of the table.

How much does a criminal defense lawyer cost in Forsyth County?

It depends on the charge and the court. Brandon quotes a flat fee for each stage of the case before you commit to anything, so you know the number for the bond hearing, for pre-trial work, and for trial if it comes to that.

Which courts do you appear in?

Forsyth County Superior, State and Magistrate Courts in Cumming; Gwinnett County courts in Lawrenceville; Cherokee County courts in Canton. Brandon prosecuted in two of those three counties and knows the judges and prosecutors by name.

I am not a U.S. citizen. Does that change my defense?

Yes, significantly. Some pleas that look minor carry deportation consequences. Delfunt Law has an immigration attorney in the same office, so every plea is reviewed for immigration impact before you sign anything.

What happens at a first appearance hearing?

Within 72 hours of arrest a magistrate reads the charges, sets or denies bond if eligible, and appoints counsel if you cannot afford it. You are not asked to enter a plea. Having a lawyer there changes the bond conversation.
