Car and truck accident claims in north Georgia

Former prosecutor. Now a trial lawyer for the injured.

If you have been hit on GA-400, T-boned at an intersection, or struck by a tractor-trailer on I-85, the insurer on the other side has already opened a file. You should have a lawyer who tries cases open one for you. Call now, before the evidence disappears.

What your claim can include

  • Medical bills, now and in the future, including physical therapy and surgery
  • Lost wages and reduced ability to earn
  • Pain, suffering and the loss of things you used to do
  • Vehicle damage, rental and diminished value (Georgia recognizes diminished value claims)
  • In truck cases, claims against the carrier as well as the driver, and the electronic logging and maintenance records that prove them

Why a trial lawyer, and why early

An insurance claim is generally valued on two things: the medical record, and whether the lawyer presenting the claim is prepared to try the case. Brandon has tried over eighty felony cases to a jury. Early involvement also preserves evidence: intersection camera footage can be overwritten within days, truck data within weeks, and witnesses become harder to reach.

Common questions

How long do I have to file a car accident claim in Georgia?

Two years from the date of the crash for injury claims under O.C.G.A. 9-3-33, and four years for property damage. If a city, county or state vehicle was involved, formal ante litem notice is required within six or twelve months, so call sooner.

What if I was partly at fault?

Georgia uses modified comparative negligence. You can recover as long as you were less than 50% at fault, with your award reduced by your percentage. Adjusters routinely overstate your share, which is one reason not to give them a recorded statement.

Should I see a doctor if I feel okay after the crash?

Yes, within a day or two. Soft tissue and concussion symptoms often appear later, and a gap between the crash and the first medical visit is the first thing an insurer uses to argue you were not hurt.

How much does it cost to hire an injury lawyer?

Nothing up front. Delfunt Law handles injury cases on a contingency fee, a percentage of what is recovered for you. If there is no recovery, there is no legal fee; case costs and expenses remain your responsibility.

What is my case worth?

Nobody honestly can tell you on the first call. It depends on the injuries, the treatment, the available insurance and the facts of fault. Schedule an appointment so we can review your case with you.
